Liability In Orange County Car Accidents

Thousands of pedestrians are killed or seriously injured in car accidents every year. According to the Centers for Disease Control, around 6,000 pedestrians are killed every year. Tens of thousands more are left with serious injuries. Most pedestrian accidents happen in the early morning hours and late evening when visibility is reduced. There are a number of factors that could potentially contribute to a car accident.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Driver fatigue

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to California Vehicle code 21950, all drivers must yield the right of way to pedestrians at any marked or unmarked crosswalks. Drivers must also slow down when there are pedestrians nearby. What could be a reasonable speed in one setting may be unreasonable in another. Liability for an accident could extend beyond a negligent driver.

If the driver of a van was working at the time of a collision, the company that they were working for could be held at fault. Generally speaking, companies are liable for the negligent conduct of their employees – insofar as those employees were working within the course and scope of their job duties. Many vans are used for commercial purposes such as the transportation of goods. Victims of pedestrian accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Organ damage
  • PTSD

The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. Damages can help cover many of the unexpected expenses that come with the sudden loss of a loved one. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are. There are, however, statute of limitations associated with civil claims.
