Liability In Fresno Pedestrian Accidents

Far too many people are killed or seriously injured in pedestrian accidents every year. Fresno, in particular, is the 10th deadliest city in the United States for pedestrians, according to a new study by Smart Growth America. Dangerous street designs were listed as one of the major contributing factors for pedestrian accidents. There are a number of steps that drivers should take in order to prevent accidents.

  • Drivers should slow down in areas with heavy pedestrian traffic.
  • Drivers should scan the road ahead of them at all times.
  • Drivers should check their blind spots before making turns in the roadway.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.” If a driver fails to reduce their speed to avoid hitting a pedestrian, this could form the basis of a negligence claim.

Trucks are often used for commercial purposes. If a truck driver was working at the time of a crash, the company that they were working for could be held at fault. In general, employers are vicariously liable for the negligent actions of their employees working within the scope of their job duties. For example, a truck driver may have been delivering packages at the time of a crash. In order to demonstrate negligence for any accident, there are numerous elements that must be established.

  • The defendant owed the plaintiff a legal duty of care.
  • The defendant breached their legal duty of care.
  • The plaintiff suffered injuries.
  • The defendant’s breach was the proximate cause of the injuries.

The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Beneficiaries in a civil claim will typically include the victim’s spouse, children, siblings and parents. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
