Liability For Sacramento Hit-And-Run Collisions

Hit-and-run collisions are very common across California. According to the AAA Foundation, “In 2016, there were 1,980 fatal hit-and-run crashes resulting in 2,049 fatalities. This is the highest annual number of hit-and-run fatalities or crashes recorded since NHTSA began compiling statistics on fatal motor vehicle crashes in 1975.” There are a number of factors that could contribute to a hit-and-run collision.

  • Speeding
  • Inclement weather
  • Driver intoxication
  • Driver fatigue

It is illegal for any driver to flee the scene of a car accident. Pursuant to California Vehicle Code 20001, the driver of any vehicle that is involved in a collision causing bodily injury or death must remain at the scene of the collision. Drivers that flee the scene of an injury collision may be subject to criminal and civil liability for their actions. There are a number of steps that should be taken after any hit-and-run collision.

  • Surveillance footage should be sought.
  • Medical records should be preserved.
  • Fragments of the fleeing vehicle should be sought.
  • An independent investigation should be conducted.

There are steps that can be taken after a hit-and-run collision to locate the at fault driver. Even a small fragment of the fleeing vehicle can help investigators determine the make and model of the car that fled. The family of any person that is killed in a car accident may have legal recourse through a wrongful death claim. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
