Liability For Mineola School Bus Accidents

School buses are normally very safe for passengers. But they can be particularly dangerous for those in passenger vehicles. According to the National Safety Council, there were 54 fatalities that involved school buses in 2020. Pedestrians and bicyclists tend to be at the greatest risk of being seriously injured or killed. There are a number of steps that school bus drivers should take to avoid collisions.

  • School bus drivers should maintain a safe distance with the vehicles ahead of them.
  • School bus drivers should slow down during periods of inclement weather.
  • School bus drivers should be well rested before heading onto the road.

School bus drivers must do everything in their power to prevent collisions and keep their passengers safe. Pursuant to Texas Transportation Code 545.103, the operator of a vehicle may not turn to enter a private road or driveway or move right or left upon a roadway unless such a movement can be made with reasonable safety. If a school bus driver makes an unsafe lane change into the path of another vehicle, this could form the basis of a negligence claim. Victims of school bus accidents tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

The FMCSA requires buses that can carry 16 ore more passengers to have at least $5,000,000 worth of liability coverage. Any person that is injured in a school bus accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A bus accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
