Liability For Celina Crane Collapse Accidents

Cranes present a number of unique safety hazards for workers in the construction industry. According to Practical Engineering, “Crane collapses lead to property damage, injuries, and fatalities every year. But, they’re almost always preventable.” There are a number of common causes of crane collapses.

  • Overloading: A crane may have been carrying more than its intended capacity, thereby causing it to tip over.
  • Improper Assembly: Cranes are massive and will often need to be assembled where they are used. If any part of a crane is not assembled correctly, this could lead to a collapse.
  • Structural Failure: A crane may experience structural failure due to corrosion or improper maintenance.

When a worker is killed or injured in Texas, they or their family will typically have recourse  through worker’s compensation. Worker’s compensation is a no-fault insurance scheme in Texas. There is no need for an injured worker to demonstrate negligence in order to receive benefits. Depending on the facts of any case, the family of a deceased worker may have legal recourse through a third party liability claim.

There could be numerous sources of third party liability for a crane accident. For example, the company that assembled a crane could be liable if it collapses. Improper assembly is the most common cause of crane accidents in the United States. Likewise, the company that operated a crane could be liable for an accident. Construction sites typically consist of a blend of different companies that must work together for a common goal. There are a number of steps that should be taken after any crane collapse.

  • Surveillance footage should be sought.
  • Eye witnesses should be interviewed.
  • The crane that collapsed should be examined.
  • A thorough investigation should be conducted.

It is important that all evidence is properly preserved after any accident. Evidence is what will ultimately paint a clear picture of what went wrong regardless of what any person claims. The family of any person that is killed in a crane collapse accident may be able to seek some measure of accountability through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A construction accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
