Morris Childers Killed In Apple Springs Box Truck Accident on State Route 94 By East Lake Road

APPLE SPRINGS, TEXAS (October 26, 2022) – A man identified as Morris Childers was killed in an Apple Springs box truck accident on State Route 94 near East Lake Road.

Trinity County officials are saying that the accident took place around 6:00 a.m. on October 7th. The driver of a 2020 international box truck was going west when they took evasive action to avoid hitting a vehicle making a left turn.

The box truck entered an eastbound lane of the roadway and collided with a Nissan driven by Morris Childers. Firefighters and paramedics were called to the scene of the collision in order to help all of the victims.

Despite life-saving measures, Morris Childers died as a result of his injuries. An 11-year-old passenger in the Nissan was taken to St. Luke’s Health Memorial-Lufkin.

A full investigation into the collision remains ongoing at this time.

Liability For Apple Springs Box Truck Accidents

Semi-trucks make up a relatively small number of the vehicles on the road. But they are involved in a disproportionate number of fatal collisions. According to the FMCSA, “Fatigue, drinking alcohol, and speeding are major factors in motor vehicle crashes overall. Although their presence does not always result in a crash, these three factors, as well as other driver, vehicle, and environmental factors, can increase the risk that a crash will occur.” There are a number of steps that truck drivers should take in order to avoid collisions.

  • Truck drivers should be well rested before the start of their shift.
  • Truck drivers should maintain a safe distance with the vehicle ahead of them.
  • Truck drivers should obey all commercial driving regulations.

All truck drivers have a legal obligation to exercise due care in order to avoid collisions. Pursuant to Texas Transportation Code Sec. 545.051, it is illegal for any driver in Texas to cross into opposing lanes of traffic except under a very limited set of circumstances. If a driver hits another vehicle after crossing into opposing traffic, this could form the basis of a negligence claim.

Depending on the facts of any case, the company that a truck driver worked for could be liable for a crash. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. However, truck companies will often try to evade liability for crashes by hiring drivers as “independent contractors.” There are a number of steps that should be taken after any truck accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • The truck’s event data recorder (EDR) should be examined.
  • An independent investigation should be conducted.

It can be difficult to know where to begin after any semi-truck accident. But it is important to remember that accident victims do have rights. The family of any person that is killed in a semi-truck accident will typically have recourse through a civil claim. Sadly, though, truck companies will often fight hard to deny liability for any crash. This is why it is so important that all evidence is properly preserved.
