Liability In Boston Garage Collapse Accidents

Demolition projects can be extremely dangerous for construction workers. According to OSHA, there have been around 20 demolition related deaths since 2019. According to the Engineering News Record, “Most fatal demolition accidents[…] happen out of public view and are not recorded by phone cameras. But they, too, often involve premature collapses or losses of support—accidents that safety experts say can be prevented with proper planning and care.” There are a number of potential causes of building collapses.

  • A building or structure may prematurely collapse if it has poor structural integrity.
  • A building may have too much weight as it is being demolished. This often occurs when heavy equipment is placed on top of a structure.
  • A building may collapse if a construction company engages in improper safety measures during the demolition process.

Depending on the specific facts of any case, there could be numerous liable parties for a construction accident. In general, employees are barred from bringing negligence claims against their employers in Massachusetts. However, an injured worker may be able to seek aid through a third party liability claim. A third party liability claim is possible when an entity separate from a worker’s employer contributed to an accident. There could be numerous sources of third party liability in any construction accident. Construction zones are typically made up of a blend of different companies.

The company overseeing a  demolition project could potentially face lawsuits if workers are injured or killed. There are strict safety guidelines that must be followed during the demolition of a building. Demolitions are inherently dangerous even when all safety standards are being followed. Other contractors could also be sued if they created an unsafe working environment or failed to properly train their employees. Companies that rent or lease construction equipment could be held liable for an accident if they failed to properly maintain that equipment in a safe condition. There are a number of steps that should be taken after any construction accident.

  • Surveillance footage should be sought.
  • Work records should be examined.
  • Employee training manuals should be reviewed.
  • Medical records should be preserved.
  • A thorough, independent investigation should be conducted.

The family of any worker that died in a construction accident may have legal recourse through a wrongful death claim. Damages can help cover lost wages, medical bills and pain and suffering. Potential beneficiaries in a civil claim will typically include the victim’s next of kin such as their spouse or children. Sadly, though, construction companies will often fight hard to deny liability for any accident. A Boston construction accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
