Liability For Hingham Car Accidents

Accidents where vehicles drive into storefronts have become increasingly common. According to one report from Slate, at least 100 American drivers veer into buildings every day. An estimated 16,000 people are injured in these accidents yearly. There are many reasons that a car might drive into a storefront.

  • Drivers may experience “pedal confusion” and mistake the accelerator for the brakes.
  • Drivers may be distracted by their cellphones or something else.
  • A vehicle may malfunction and the accelerator may become stuck.

All drivers have a legal obligation to exercise due care to avoid collisions. They must continuously scan the road ahead of them and operate their vehicle at a safe speed. There is a rebuttable presumption of negligence on the part of any driver that leaves a roadway and hits a pedestrian on a sidewalk or in a store. Depending on the facts of any case, liability for a storefront collision could extend beyond any driver.

Companies have a legal responsibility to maintain their premises in a reasonably safe manner. This may include protecting customers from the possibility of vehicles driving into a storefront. There are steps that companies can take to protect customers from errant vehicles. Bollard posts are rigid metal or concrete structures designed to stop vehicles from entering certain areas. In certain situations, a lack of bollard posts could form the basis of a negligence claim. There are a number of steps that should be taken after a car accident.

  • Surveillance footage should be sought.
  • Medical records should be preserved.
  • Eye witnesses should be interviewed.
  • Reports of other accidents in the same location should be examined.

When there is a history of storefront collisions at a certain location, a property owner may need to take action and install bollard posts or other safety measures. The family of any person that is killed in a storefront collision may have legal recourse through a wrongful death claim. Any person that is injured in such a collision may have recourse through a bodily injury claim. It is extremely important that all evidence is properly preserved after any collision.
